Mahesh Nayka, a resident of Holebenavalli village under Shimoga Rural Police Station, 40 years old and his acquaintances Kumara Nayka, Feeryanayka, Chinna Nayka and Madhu @ Madhukumar on their bike on 05-05-2017 in the afternoon on 05-05-2017 in their bike keeping in mind the issue of contesting in the village panchayat elections. A case under Gunne No. 0175/2017 Clause 143, 302 and 149 IPC has been registered on the complaint filed by the deceased’s wife that when they were going on the small Tanda channel of Holebenavalli, all the accused intercepted Mahesh Naik and killed him with a sharp weapon.
The then investigating officer Shri Gangadharappa R.V. The CPI Shimoga Rural Circle has investigated the case and filed a charge sheet against the accused before the High Court.
Mrs Pushpa, Government Prosecutor argued the case and the case was heard in the 2nd Additional District and Sessions Court Shimoga before Hon’ble Judge Mrs BR Pallavi on 10-03-2023 Accused 1) Kumar Nayka, 36 years, Holebenavalli, Shimoga, 2) Feerya Nayka, 38 years, Holebenavalli, Shimoga, 3) Chinna Nayka, 32 years, Holebenavalli, Shimoga and 4) Madhukumar @ Madhu, 19 years, Mussenal village Shimoga have been sentenced to life imprisonment under Sections 143, 302 and 149 IPC. And a fine of Rs.23,500/-, in case of failure to pay the fine, an additional 03 years of simple imprisonment has been ordered.
